EB-5 Investor Green Card


The Employment Based Fifth Preference Category, or better known as the EB-5, was created to entice overseas capitalist to the United States in order to create  jobs, opportunities, and to help the United States economy. At the moment, there are 10,000 EB-5 immigrant visas available annually.

There are two awesome EB-5 pathways for an immigrant investor to obtain lawful permanent residence for themselves and their immediate family—the Basic Program and the Regional Center Pilot Program.


Both applications require the immigrant to make a capital funding in different amounts (depending on whether or not the funding is in a Targeted Employment Area [TEA] or not) in businesses in the United States. TEA is described as “a rural area or an area that has experienced high unemployment of at least 150% of the national average.”  The new business enterprise create 10 full-time jobs for qualifying U.S. workers within two years (or within a realistic time after the two-year period) of the immigrant investor’s admission to the United States as a Conditional Permanent Resident (CPR).

HOW MUCH SHOULD I INVEST?

In order to qualify under the 2022 EB-5 Reform and Integrity Act, the Summary of the Terms, investors must:


• Invest $1,050,000.00 million (non-TEA) or,

• $800,000 (TEA);

TEA is Targeted Employment Area and is defined as:
– Rural areas
– Areas with unemployment 1.5x of the national average

U.S. company that will create at least 10 full-time U.S. jobs, or


• Prove that the funding will improve the U.S. economy

Here are the costs for every situation:


How Much Will An EB-5 Cost?

The EB-5 cost will depend on whether you go through consular processing or adjust your status. Here are the mandatory fees for each situation:

Adjustment of Status

  • I-526 filing fee: $3,675

  • I-485 fee: $750-$1,140. This fee will depend on your age.

  • Biometrics fee: $85 (if applicable)

  • Affidavit of support fee: $85 (if applicable)

Legal fees

  • Attorney fee: These fees vary widely. Usually will be circa $75,000.00

  • Traveling costs (if required)

**** There is a whole host of pitfalls that you could encounter when dealing with fee payment. From knowing which fees to pay to learning where the fees need to be sent, it can be very easy to cause your petition to be rejected on account of a mistake in the fees. That’s why it is never recommended to go through the EB-5 process without an experienced immigration attorney’s help. ****

WHY DO I NEED AN EB-5 LAWYER?

A good law firm will cost you, but it will greatly increase the chances of success for you and your family. Think about it this way.  Usually, attorneys charge 33% and higher on certain types of cases.   For this type of case, you are investing over a million dollars for you and your family to be in the United States legally, while at the same time, creating an economic lifestyle.   The amount you pay a law firm for you and your family’s peace of mind (and many times, safety) is less than 7% of the total amount you will be investing (if it were to be based on a contingency agreement). Again, an EB-5 lawyer can greatly assist your chances of having green cards for you and your family.
